1. Parties & Booking
This Agreement is entered into between The Lilac House Property ("Owner") and theRenter ("Photographer") booking the space via [luckybugfarmnh.com]. By completing the booking and payment on our website, the Photographer agrees to be bound by the terms below.
2. Rental Period
Time: The rental period includes setup, shooting, and clean-up time.
Overtime: The Photographer must vacate the premises by the end of the booked slot. Unauthorized overstay will result in an additional fee of [$50/rate] per half hour, chargeable to the card on file.
3. Payment, Cancellation, Rescheduling & Weather
3.1 Payment: Full payment is required at the time of online booking to secure the time slot.
3.2 Cancellations & Rescheduling Policy:
(a) More than 14 Days Before Booking: If the Photographer cancels more than fourteen (14) full days prior to the scheduled start time, they may choose either:
(i) A 50% refund of the total booking fee (the remaining 50% is retained as a cancellation fee to cover administrative costs and lost opportunity), OR
(ii) A free reschedule to a new date, subject to our availability. In this case, 100% of the paid amount will be transferred to the new booking.
(b) Within 14 Days of Booking (Strict No Refund): If the Photographer cancels within fourteen (14) days or less of the scheduled start time, NO REFUND will be issued for any reason (including client no-shows or changes of plans). The full booking fee is forfeited. Free rescheduling is not available within this window; any request to move the date will be considered at the Owner's sole discretion and may require a new, full booking fee.
3.3 Severe Weather (Exception): If the Owner determines that severe weather (such as high winds threatening the glass, dangerous lightning, hailstorms, or flooding) makes the greenhouse unsafe or unusable for the rental period, the Owner will cancel the booking. In this event, the Photographer may choose either:
(a) A full refund of all amounts paid, or
(b) A free reschedule to a future date, subject to availability.
Note: Mild rain, overcast skies, or normal seasonal temperatures do not qualify as severe weather, and the booking will proceed as scheduled without a refund.
4. Rules of Conduct & Care of Property
The Photographer agrees to the following strict rules to protect the plants, glass structure, and overall environment:
No Smoking/Vaping: Strictly prohibited inside the greenhouse or within 20 feet of the entrance.
No Props that Damage or Create Mess: Do not bring props that leak water, dirt, paint, oil, or sticky substances onto the floors. The use of glitter, confetti, feathers, smoke bombs, fog machines, sparklers, or any other pyrotechnic devices is strictly prohibited. Any residue or staining left behind will incur an immediate cleaning fee of [$75] charged to the card on file.
Plant Handling: Do not touch, move, or prune the plants without prior written permission. If a plant is accidentally knocked over or damaged, please notify staff immediately.
Furniture: Any provided furniture (tables, chairs, stands) may be moved gently. Please return all furniture to its original position before leaving.
Weather: If the greenhouse doors are opened during cold/hot weather, they must be closed immediately after the shot to protect the internal climate.
5. Assumption of Risk & Liability
Equipment: The Owner is not responsible for any damage, theft, or loss of the Photographer’s personal equipment (cameras, lights, laptops) while on the premises.
Personal Injury: The Photographer and their clients/models enter the greenhouse at their own risk. The Owner is not liable for slips, falls, or injuries resulting from uneven ground, irrigation lines, or plant debris.
6. Damage to Greenhouse/Plants
The Photographer is financially responsible for any damage to the greenhouse structure, glass panels, or plant life caused by the Photographer, their clients, or their assistants during the rental period. Repair/replacement costs will be charged to the Photographer.
7. Insurance
The Photographer is encouraged to carry General Liability Insurance. If the Photographer is a professional business, they agree to provide a Certificate of Insurance (COI) upon request.
8. Usage Rights (For the Owner)
By booking, the Photographer grants the Owner permission to share photos taken inside the greenhouse on the Owner’s social media or website for promotional purposes, with photo credit given to the Photographer. (The Photographer retains all other commercial rights to their images).
9. Animals & Livestock (Strict Liability)
No Interaction with Farm Animals: For safety and liability reasons, the Photographer, their clients, assistants, and models must not approach, touch, feed, chase, or otherwise interact with any livestock or animals residing on the farm property.
No Outside Pets: Under no circumstances are the Photographer's personal pets, client's pets, or any other outside animals permitted inside the greenhouse or anywhere on the farm grounds during the rental period.
Violation: Breaking this rule will result in immediate termination of the booking without a refund, and the Photographer will be held liable for any veterinary or incident-related costs arising from the interaction.
10. Termination
The Owner reserves the right to terminate the rental immediately without refund if the Photographer violates the "Rules of Conduct" (Section 4), "Animals & Livestock" (Section 9), or behaves in a manner that endangers the property, plants, or animals.
